Wi-Fi Terms of Use

 

General

We are offering this guest Wifi wireless Internet service (the “Service”) according to this Guest Wifi Wireless Networking Acceptable Use Policy (the “Policy”) as a free, non-public service to its customers for the duration of their official trip.  All users of this Service must agree to the terms of this Policy by clicking the ACCEPT button. We do not guarantee the Service or specific rates of speed. We also have no control over information obtained through the Internet and cannot be held responsible for its content or accuracy. Use of the service is subject to the user’s own risk. We reserve the right to remove, block, filter, or restrict by any other means any material that, in our sole discretion, may be illegal, may subject us to liability, or may violate this, Policy. We may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Violations of this Policy may result in the suspension or termination of access to the Service or other resources, or other actions as detailed below.

 

By using this service, you agree to comply with the terms and conditions of this agreement (the Terms), as may be amended by AfriKonekta and its partners from time to time.  If at any time you do not agree to any of these Terms, or find them unacceptable, you must immediately cease all use of this service. By accepting this agreement and accessing the wireless network, you acknowledge that you are of legal age, you have read and understood, and agree to be bound by this agreement.

 

(*) The wireless network service is provided by AfriKonekta and partners and is completely at their discretion. Your access to the network may be blocked, suspended, or terminated at any time for any reason.

(*) You agree not to use the wireless network for any purpose that is unlawful or otherwise prohibited and you are fully responsible for your use.

(*) The wireless network is provided "as is" without warranties of any kind, either expressed or implied. 

 

Use of your personal data

By proceeding to use the service, you acknowledge that AfriKonekta will process personal data relating to you in order to provide access to the service, to monitor and improve the service and to prevent unauthorised use of the service.

 

1. Use and availability of the service

 

1.1. You agree that whilst using this service, you will comply with all applicable laws, rules and regulations and not use this service for any purpose that is fraudulent, unlawful, defamatory, obscene, offensive, abusive, malicious or harmful in nature or in any way which is considered discriminatory or harassment.

1.2. You agree that you will use the access provided responsibly and with full regards to the safety, security, and privacy of all other users, devices and resources.

1.3. You agree that AfriKonekta will not assume any responsibility if information you transmit across twhile using the service is accessed, altered or corrupted. You also accept that AfriKonekta is not responsible for any unauthorised access to your computer/device, or the introduction of any virus or other harmful code, that may result from use of this service.

1.4. You are responsible for obtaining, maintaining and setting up your own equipment and hardware in order to access and use the service and you take responsibility for the protection of your equipment through the use of up to date virus protection, personal firewalls and any other suitable measures you deem necessary.

1.5. You accept that AfriKonekta may be required to take the service down for periodic maintenance or unforeseen downtime and may do so without notice at any time at its discretion.

1.6. You accept that the service may be interrupted as the bus move from one region to another due to service provision unavailability.  

 

1. Termination

 

1. 1. AfriKonekta may suspend, withdraw, or discontinue the provision of this service without notice at any time at its discretion.

 

1. Indemnity

 

1. 1. You agree to indemnify AfriKonekta and its partners, directors and employees against any and all losses suffered by AfriKonekta, as a result of your use of this service in breach of these Terms.

 

1. Warranties

 

1. 1. AfriKonekta is providing this service to you "as is" without warranty of any kind. You assume the risk of any and all damage or loss from use of, or inability to use the service. 
      
      4.2. To the maximum extent permitted by law, AfriKonekta expressly disclaims any and all warranties, express or implied, regarding the service and AfriKonekta performance of this agreement, including but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non infringement. AfriKonektadoes not warrant that the service will meet your requirements or that the operation of the service will be uninterrupted or error free.

 

1. Liability

 

5.1. To the maximum extent permitted by law, in no event will AfriKonekta be liable for damages of any kind (including but not limited to, special, incidental or consequential damages, lost profits or lost data, regardless of the foreseeability of those damages) arising out of or in connection with the use or performance of the service or any other material or services provided to you by AfriKonekta.

5.2. The limitation will apply regardless of whether the damages arise out of breach of contract, tort, or any other legal form of action. Without limiting the foregoing, in no event will AfriKonekta aggregate liability to you relating to or arising out of this agreement, whether in contract, tort or otherwise, exceed the total amount, if any, paid by you to AfriKonekta for your use of the service as set out herein.

 

1. Governing law

 

6.1. These Terms and all matters arising from or in connection with them shall be governed by and construed in accordance with Finnish law and the parties irrevocably submit to the exclusive jurisdiction of the courts of countries of operation.
